Pre-Settlement Funding Basics

What pre-settlement funding is, how it works, and why it's different from a traditional loan. Start here if you're new to the concept.

Learn about PI funding →
What is pre-settlement funding?
Pre-settlement funding is a cash advance against the future proceeds of a pending lawsuit. It's designed for plaintiffs in personal injury cases who need money now to cover expenses while their case is still being settled. Unlike a traditional loan, repayment is only required if you win your case — which is why it's called non-recourse funding.
Is pre-settlement funding a loan?
In most states, no. It's structured as a non-recourse cash advance against your future settlement, which means it doesn't function like a traditional loan. There are no monthly payments, no interest ticking up while your case is open, and no repayment obligation if your case doesn't win. In a small number of states, regulation requires this product to be structured as a loan, but the core principle — repayment contingent on winning — remains the same.
What does "non-recourse" actually mean?
Non-recourse means we have no recourse to collect from you if your case doesn't win. If you lose, we get nothing. That's the risk we take on. There's no fine print, no clawback provision, and no "if you lose, you still owe us" trick. The risk lives with us, not with you.
What kinds of cases qualify?
We fund most personal injury case types including auto accidents, slip and fall, medical malpractice, workers' compensation, wrongful death, product liability, trucking accidents, dog bites, and many others. To qualify, you generally need to have a valid pending case with an attorney representing you. Our team can confirm eligibility during your initial application review.
Do I have to have an attorney to qualify?
For pre-settlement funding, yes. You must have an attorney representing you in your case before we can fund. This is standard across the industry — your attorney doesn't have to approve the funding, but they do need to be part of the process because repayment comes from the eventual settlement proceeds.
Is pre-settlement funding available in my state?
Pre-settlement funding availability varies by state due to differing state-level regulations on legal funding. We operate in most states, though product form, rate structure, and specific requirements can differ. Our team can confirm exactly what's available in your state when you contact us.
How is pre-settlement funding different from a personal loan?
A personal loan requires monthly payments, charges interest that accrues over time, requires a credit check, and holds you personally liable for repayment regardless of any other circumstances. Pre-settlement funding has no monthly payments, no credit check, and repayment is only required if your case wins. If you lose, you owe nothing.

Applying & Getting Approved

How the application process works, what we look at, and how fast you can expect a decision. If you're ready to apply, this section is for you.

Apply now →
How do I apply?
You can apply online through our application page or by calling us at (347) 634-2802. The online application takes about 3 minutes to complete. We'll need your contact info, basic details about your case or business, and (for PI funding) your attorney's information. A specialist will follow up within the hour during business hours to walk you through next steps.
How long does the application take?
About 3 minutes to submit the initial form. After that, a funding specialist calls you to gather any additional details and walk you through the process. Most PI approvals happen within 24 hours of receiving the required documents from your attorney. Business funding decisions are typically same-day.
Will applying affect my credit?
Not for pre-settlement funding. We do not pull your credit report or check your credit score as part of the PI funding process. For business funding, any credit inquiry (if needed) is disclosed to you in advance and does not typically involve hard credit pulls that damage your score.
Do you check my credit for pre-settlement funding?
No. Your credit score is not a factor in our pre-settlement funding decisions. We evaluate the strength of your case — not your credit history. Bad credit, no credit, past bankruptcy, or ongoing collections don't disqualify you.
What documents do you need from me?
For pre-settlement funding, we work primarily with your attorney to get the documents we need — typically the complaint, police or incident report, medical records or summaries, and an estimated case value. You may need to sign an authorization allowing your attorney to share these with us. For business funding, we typically ask for the last 3 months of business bank statements.
How fast will I hear back after applying?
A funding specialist typically calls you within the hour during business hours. After the initial call, once we've received the documents we need from your attorney (for PI) or your bank statements (for business), most decisions come within 24 hours.
What if I get denied?
If we can't fund your case or business, we'll tell you why. In some cases, the reason is temporary — for example, we may be waiting on additional documentation, or your case may need to progress further before we can evaluate it. In other cases, we may not be the right fit, and we'll be honest about that too rather than stringing you along.

Money & Repayment

How much you can get, how you get paid, what our fees look like, and how repayment works at settlement. The dollars-and-cents section.

See what you qualify for →
How much money can I get?
For pre-settlement funding, advances typically range from $500 to $100,000, depending on the strength and estimated value of your case. Larger amounts are considered for exceptionally high-value cases with strong documentation. For business funding, product-specific ranges vary: merchant cash advances typically run $5,000 to $2 million, equipment financing goes up to $5 million, and term loans and lines of credit have their own structures.
How quickly will I get the money?
Once your funding is approved and paperwork is signed, funds are typically wired directly to your account within 24 hours. Some cases move faster — same-day funding is possible on straightforward applications where all documents are in order and the paperwork is signed before our cutoff.
How do I get the money once I'm approved?
Funds are wired directly to your personal bank account (for PI funding) or your business bank account (for business funding). We don't send checks by mail, hold funds in escrow, or require you to pick anything up in person. Direct deposit, and it's yours.
Are there any upfront fees?
Never. There are zero fees to apply and zero out-of-pocket costs to receive funding. No application fee, no processing fee, no origination fee that you pay upfront. For pre-settlement funding, our fee is only collected from your settlement proceeds — and only if you win. For business funding, all fees and terms are disclosed in writing before you sign.
What can I use the money for?
Anything. There are no restrictions on how you use pre-settlement funding. Rent, mortgage, medical bills, groceries, car payments, childcare, utilities — it's your money. For business funding, funds are for business use (payroll, inventory, equipment, expansion, etc.) as outlined in the funding agreement.
How is repayment handled at settlement?
For pre-settlement funding, your attorney typically pays us directly from the settlement proceeds as part of the disbursement process at case resolution. You don't have to write us a check, wire us funds, or handle anything yourself. It's coordinated between our team and your attorney's office. We provide a written payoff amount so there are no surprises.
What if I lose my case?
If your case doesn't win, you owe us nothing. That's the whole point of non-recourse funding. No fine print, no clawback, no "you still owe us the principal." If you lose, we lose. The risk lives entirely with us.
Can I pay off my advance early?
Yes. If your case settles faster than expected, or if you come into money and want to pay us off ahead of schedule, we accommodate early payoff without penalty. Contact us for a written payoff quote and we'll walk you through the process.

Attorneys & Your Case

How we work with your attorney, what we ask for, and what to expect from the coordination process. Also covers attorney partnership questions.

For attorneys →
Do I need to tell my attorney I'm applying?
Yes. Your attorney needs to be involved because they'll be part of the process — sharing case documents, confirming case status, and handling repayment from settlement proceeds. We'll actually reach out to your attorney directly once you submit your application, so you don't have to do all the coordination yourself.
Will my attorney block me from getting funding?
Your attorney doesn't have veto power over your funding decision. However, they will be involved in the paperwork because the funding is secured against your case proceeds. Most personal injury attorneys are familiar with pre-settlement funding and will cooperate quickly. If your attorney has never worked with a funder before, we can walk them through the process.
What if I don't have an attorney yet?
For pre-settlement funding, you'll need to secure representation before we can fund your case. If you don't have an attorney yet, we can point you to resources for finding personal injury counsel in your state. We can accept your initial application in the meantime, but funding cannot be finalized until you're represented.
Do you pay attorneys referral fees for sending clients?
No. Marketing fees, kickbacks, and referral incentives to attorneys are prohibited by legal ethics rules — and we would not offer them even if they weren't. Our relationships with law firms are built on providing a service that helps their clients, not on financial arrangements that would compromise the attorney-client relationship.
How does your team coordinate with my law firm?
Once you apply, one of our funding specialists is assigned to your case. That specialist coordinates directly with your attorney's office through their designated contact — usually a paralegal or case manager. We ask only for what we need to underwrite the case, and we don't cross-communicate with clients about matters that should go through your attorney.
My attorney is skeptical about funding. What should I tell them?
Ask them to call our attorney desk directly at (347) 634-2802. Many attorneys who are skeptical about funding become long-term partners once they see how we operate — transparent rates disclosed upfront, no client solicitation around the firm, and clean coordination through their office. Our team is happy to answer their questions.

Business Funding

How our business funding products work — MCAs, equipment financing, term loans, and lines of credit. This section is for small and mid-sized business owners.

See business funding →
What types of business funding do you offer?
We offer four main products: merchant cash advances (revenue-based capital), equipment financing (for machinery, vehicles, and business equipment), term loans (fixed-term structured capital), and business lines of credit (flexible draw-down credit). Each product is designed for different use cases and business situations.
What do I need to qualify for business funding?
Most of our products require: at least 6 months in business, minimum monthly revenue (typically $15,000 or more), a U.S. business bank account, and a valid business entity (LLC, corporation, or sole proprietorship). Specific requirements vary by product. For MCAs, we focus primarily on revenue. For equipment financing, we look at the equipment being financed. Term loans and lines of credit have their own criteria.
How fast can I get business funding?
Most business funding decisions are same-day. Once approved and paperwork is signed, funds are typically wired within 24 to 48 hours. Simple MCAs on strong revenue can move faster. Larger equipment financing and complex term loans may take slightly longer depending on documentation review.
Do you check personal credit for business funding?
It depends on the product. For merchant cash advances, we focus primarily on business revenue and bank statements rather than personal credit. For term loans and larger equipment financing, we may consider personal credit as one factor among many, but it's usually not the deciding factor. We'll disclose exactly what we're checking before you apply.
How much business funding can I get?
Ranges vary by product: merchant cash advances typically run from $5,000 to $2 million, equipment financing goes up to $5 million, and term loans and lines of credit are structured based on your business's revenue and needs. The amount you qualify for depends on your revenue, time in business, and the specific product.
What industries do you fund?
Nearly all of them. We fund restaurants, retail, construction, trucking and logistics, medical and dental practices, automotive, professional services, e-commerce, manufacturing, real estate, and more. Some highly regulated industries have restrictions, but most small and mid-sized businesses qualify for at least one of our products.
Can I get business funding if my business is less than 6 months old?
It's more difficult, but not impossible. Most of our standard products require at least 6 months in business. If your business is newer, our team can discuss what's realistic given your situation — including startup-friendly products or timelines for when you'd become eligible.
